1. Whether the city must do its own tax assessment of a property, outside of the county's assessment, before imposing a millage?

No. In fact, OCGA 48-5-352 says that in determining the fair market value of property within their respective tax jurisdictions for purposes of ad valorem property taxation, municipalities shall use the fair market value finally determined for the property for county ad valorem property taxation purposes. Fair market value shall be finally determined for county ad valorem property taxation purposes when all means for administrative and judicial review of the fair market value have been exhausted or are no longer available.

2. Whether the city must maintain a tax department and/or tax assessor?

No. A tax assessor/tax department is only required if our charter required it. See OCGA 48-5-353. Our charter does not require that we maintain a tax department/assessor.

3. Whether the city must put the imposition of the millage to a vote of its citizens?

No. OCGA § 48-5-32.1 says whenever a levying authority shall propose to adopt a millage rate which does not exceed the roll-back rate, it shall adopt that millage rate at an advertised public meeting and at a time and place which is convenient to the taxpayers of the taxing jurisdiction.

4. Whether more than one homestead exemption may be claimed on a property?

No. OCGA 48-5-40 says no more than one exemption may be claimed pursuant to this subparagraph in connection with the occupancy of one building, except in the case of a duplex or double occupancy dwelling when the line of division follows a natural and bona fide plan as to both land and building and the two units thus formed are separately owned and occupied.

5. Did the city violate any law when implementing the millage?

No. The City has adopted the millage in accordance with law.

1. Can I remain anonymous when reporting a code enforcement violations?

Yes. We do not require that you provide any personal information. Remember that all information you choose to provide to the City, including names, phone numbers, or email addresses, is subject to the Public Record Laws. In other words, we must provide this information to anyone who asks for it. If you wish to remain completely anonymous, do not provide your personal information.

2. What do I do if I've received a notice of violation from Code Enforcement?

If you have any questions about what is required of you to achieve compliance with Lovejoy's Code Enforcement, please contact the investigator assigned to your case. The investigator’s name is listed at the bottom of the notice you received. You can also call our main number at (770) 471-2304 and speak to anyone in the Clerk's office.

The goal of Code Enforcement is to preserve the quality and value of public and private property and maintain a high standard of living by eliminating conditions that threaten the life, health, safety, and general welfare of the public. The Department recognizes that this goal is most effectively achieved through the education of, and cooperation with, the citizens of Civic City.

3. What is an abandoned or unserviceable vehicle and why are they considered to be a violation of City Codes?

The Lovejoy Ordinance describes an unserviceable vehicle as any vehicle which is required to be licensed and registered by the State of Georgia and is not licensed and registered and is in such condition that it cannot be started or moved under its own power without repair. Derelict vehicles typically leak fluids such as anti-freeze, gasoline and other automotive fluids onto the ground, contaminating the local area.

These vehicles also create an attractive nuisance to children by presenting an enticing, but dangerous, plaything. There are several documented incidents of children becoming locked inside a vehicle and succumbing to the extreme temperatures produced within the vehicle. Inoperative vehicles also detract from neighborhoods appearance and can invite an undesirable element into your community.
